Terms of Use
1. Acceptance of Terms
By creating an account or using Parlera ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, you must not use the Service. These Terms form a binding legal agreement between you and Parlera ("we", "us", "our").
By ticking the acceptance checkbox at signup, you confirm you have read, understood, and agree to these Terms and our Privacy Policy.
2. Description of Service
Parlera is an online educational platform that enables one-to-one and group tutoring sessions between teachers and students via live video ("Studios"). During sessions, Parlera may transcribe audio in real-time and use that transcript to automatically generate revision materials for students.
3. Age Requirements
You must be at least 13 years old to use Parlera. If you are under 18 years old, you must have the consent of a parent or legal guardian before using the Service. By using the Service, you represent that you meet these age requirements.
Teachers are responsible for ensuring that any student they invite to a Studio has obtained appropriate parental consent where required.
4. User Roles and Responsibilities
4.1 Teachers
- You must provide accurate information when setting up your teacher profile.
- You are responsible for obtaining consent from students (or their guardians) before recording or transcribing any session.
- You must not share Studio join codes publicly or with unauthorised persons.
- You are responsible for the content of sessions you host and the materials you share.
- You must not use Parlera to provide services that require government registration or licensing (e.g. psychological counselling) unless appropriately qualified and disclosed.
4.2 Students
- You must use your real name or a name known to your teacher when joining a Studio.
- You acknowledge that sessions may be transcribed and that AI-generated revision materials may be created from session content.
- You must not share session content (transcripts, revision materials) publicly without the permission of your teacher.
5. Acceptable Use Policy
Parlera is for educational use only. You must not use the Service to:
- Harass, bully, intimidate or abuse any other user;
- Share, distribute or create illegal, offensive, defamatory or sexually explicit content;
- Impersonate another person or organisation;
- Attempt to gain unauthorised access to other users' accounts or data;
- Use automated scripts, bots, or scrapers against the Service;
- Resell, sublicence, or commercialise access to the Service without our written permission;
- Use the Service in any way that violates applicable Australian or international law.
6. Studio Session Conduct
All participants in a Studio session are expected to behave respectfully and professionally. Parlera reserves the right to terminate sessions and suspend accounts where conduct violates these Terms.
You acknowledge that each Studio session may be transcribed in real-time by Deepgram and that an AI (Anthropic Claude) may process the transcript to generate revision materials. A notice of this is displayed before every session and must be acknowledged before joining.
7. Intellectual Property
7.1 Your Content
You retain ownership of the content you create and share in sessions, including your spoken words, uploaded files, and whiteboard drawings ("User Content").
7.2 Licence to Parlera
By using the Service, you grant Parlera a non-exclusive, worldwide, royalty-free licence to process, store, and transmit your User Content solely for the purpose of providing the Service to you (including transcription and AI generation of revision materials).
7.3 AI-Generated Materials
Revision materials generated by Parlera's AI from session transcripts are made available to the teacher and the participating student(s). Neither party may resell or commercially exploit these materials without the written consent of the other.
7.4 Parlera's Intellectual Property
All software, design, trademarks, and branding of Parlera are our property. You may not copy, modify or distribute them without our express written permission.
8. Account Termination
We may suspend or terminate your account immediately if you:
- Violate any provision of these Terms;
- Engage in conduct that is harmful to other users or to Parlera;
- Provide false information during registration;
- Fail to pay any applicable fees (if introduced in future).
You may delete your account at any time by contacting privacy@parlera.app. Upon deletion, your data will be handled in accordance with our Privacy Policy.
9. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranty of any kind. We do not guarantee the accuracy of AI-generated revision materials — they are tools to support learning, not a substitute for professional educational advice.
To the maximum extent permitted by law, Parlera's liability for any loss or damage arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you by email or by displaying a notice in the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
